Mandatory SB's - are they?

Hello evrybody

Now an new question cross my mind (in french: me vient à l'esprit ):
must mandatory SB be or not applied systematically ?

That all depends on who is claiming that it is "mandatory"

For those of us under the venue of the FAA, the answer is no in most cases. There are too many variables that could affect the answer to give a yes/no.

Mr. or Ms. Anonymous is correct; the answer is a definite maybe. It is ultimately up to you to decide but some basic facts to consider:

The manufacturer can not write laws so they can not make something legally mandatory.

OEMs can set requirements for support, warranty etc that could include required performance of items.

You are governed by you operational manuals and designated maintenance programs. Do you require the compliance of Mandatory SB in your accepted policies and processes?

If there is a incident and litigation are you at increased risk if manufacturer recommended or required items have not been performed?

I agree with you, the manufacturer can not write laws.
nothing is write in my approuved maintenance programs that say that all mandatory SB from OEM must be applied .
So i thing is your own "engineering jugement" that it could request to apply or not them. Now in case of incident it will be necessary to prove to the autorithy and insurance that you decided to not apply them based on experience, operating condition, aicraft aging, etc...

While the manufacturer cannot write law, the Civil Aviation Authority having jurisdiction can write law that would make certain manufacturers service information such as service bulletins mandatory. Here in FAA land, it has to go through the NPRM process beforehand where the public has an opportunity to oppose it. Not so in all countries. (: Check with your CAA, your mileage may vary.

Of course but in this case, will FAA issue an AD to request SB mandatory application on all concerned aircraft ?

What "case"? No one has postulated a scenario as of yet other than a generic, "Do Mandatory SB's apply".

i used 'in this case' to say 'generaly' if a SB mandatory must be applied by everbody on affected aircraft or components, Authority will issue an AD.
